Your use of a third-party financial data service is also subject to that provider’s applicable terms and privacy policy.

3. OUR COMMUNICATIONS WITH YOU

We may communicate with you using contact information you provide to us to provide information about our Services, respond to inquiries, provide customer support, or communicate other information that may be relevant to your relationship with us.

3.1 Consent to Communications

Consent to receive promotional communications is not a condition of purchasing our Services.

3.2 Telephone Calls

You may opt out of SMS communications at any time by replying STOP to a message where supported.

After receiving an opt-out request, we may send a confirmation message and stop sending messages associated with that messaging program, subject to applicable legal or operational requirements.

Wireless carriers are not responsible for delayed or undelivered messages.

3.4 Email Communications

You may receive informational, transactional, service-related, or promotional communications from Consumer Credit Counseling LLC by email.

You may unsubscribe from promotional emails by using the unsubscribe instructions contained in the applicable email.

3.5 Opting Out of Communications

You may request to stop receiving promotional calls or emails by contacting:

Please identify the type of communication you no longer wish to receive.

Your request will become effective after we have had a reasonable opportunity to process it.

You may stop SMS/MMS communications by replying STOP to the applicable message where supported.

Opting out of promotional communications does not prevent us from sending necessary service-related, transactional, legal, security, or other non-promotional communications.

3.6 Chat

We may provide an interactive online chat service (“Chat”) as a convenience to visitors and customers.

The Chat service may not always be available and may contain errors or delays.

Information provided through Chat is intended for general informational and customer-service purposes and does not necessarily constitute a legal agreement, representation, warranty, or guarantee regarding our Services.

3.7 AI and Automated Chat Technologies

The Chat service may include chatbots, virtual assistants, AI systems, automated agents, or similar technologies operated by Consumer Credit Counseling LLC or third-party providers.

Where required by law, we will provide appropriate disclosure regarding the use of automated or AI technologies.

4. CONTENT YOU SUBMIT AND COMMUNITY USAGE RULES

4.1 User-Generated Content

You generally retain ownership rights that you may have in your UGC, subject to the rights granted to Consumer Credit Counseling LLC under these Terms and applicable law.

4.3 License to Consumer Credit Counseling LLC

4.6 Community Usage Rules

When using any community or interactive portion of the Service, you agree that you will not:

  • Harass, threaten, abuse, stalk, or harm another person.
  • Post defamatory, obscene, sexually explicit, or unlawful content.
  • Impersonate another person or organization.
  • Submit fraudulent, deceptive, or materially misleading information.
  • Upload content that infringes intellectual property rights.
  • Collect personal information from other users without authorization.

5. SERVICE AND CONTENT USE RESTRICTIONS

You agree that you will not:

  1. Use the Service for unlawful purposes.
  2. Use the Service to harm, harass, threaten, or defraud another person.
  3. Attempt to gain unauthorized access to the Service or related systems.
  4. Circumvent security features or access controls.
  5. Interfere with the operation of the Service.
  6. Introduce malicious code or harmful technologies.
  7. Harvest or collect personal information about other users without authorization.
  8. Use robots, spiders, scrapers, crawlers, or automated tools to collect or copy Content except where expressly permitted.

6. CREATING AN ACCOUNT

If account registration is available, you are responsible for maintaining the confidentiality and security of your login credentials.

You are responsible for activity occurring under your account unless caused by circumstances for which you are not legally responsible.

7.2 DMCA Contact

We may remove or disable access to allegedly infringing material where appropriate and permitted by applicable law.

We may also notify the person who submitted the allegedly infringing material and may provide that person with the information contained in the notice as permitted by law.

7.3 Counter-Notification

If material you submitted is removed or access to it is disabled because of a copyright infringement notice, and you believe the removal resulted from mistake or misidentification, you may submit a DMCA Counter-Notification.

A counter-notification should include the information required by applicable copyright law, including identification of the material, a statement made under penalty of perjury, your contact information, required jurisdictional consent, and your signature.

9. ARBITRATION AND DISPUTE TERMS

We value our relationship with customers and website visitors and encourage you to contact us first if you have a concern or dispute.

Where permitted by applicable law and unless an exception applies, certain disputes between you and Consumer Credit Counseling LLC may be resolved through individual arbitration rather than in court.

9.1 Mandatory Arbitration

To the extent legally enforceable, disputes that cannot be resolved informally may be resolved through private, individual arbitration.

This may mean that, to the extent permitted by law, you and the Company waive certain rights to have a dispute decided by a judge or jury or to participate in a class action.

An arbitrator may generally award the same types of individual damages and relief that a court could award under applicable law.

Nothing in this Arbitration Agreement is intended to waive rights that cannot legally be waived.

9.2 Definitions

“We,” “us,” “our,” and “Company” mean Consumer Credit Counseling LLC and its applicable affiliates, successors, assigns, officers, directors, employees, agents, representatives, contractors, and service providers.

“You” and “your” mean the individual or entity using the Service or asserting a claim.

“Claim” means any dispute, claim, or controversy arising out of or relating to your relationship with Consumer Credit Counseling LLC, your use of the Service, communications with us, our Services, our use of information, or these Terms, to the maximum extent permitted by law.

9.3 No Class Actions; Individual Relief Only

To the extent permitted by applicable law, disputes subject to arbitration shall be resolved on an individual basis.

Neither you nor Consumer Credit Counseling LLC may participate in a class action, collective action, representative action, or consolidated proceeding concerning a covered Claim, except where such waiver is prohibited by applicable law.

An arbitrator may provide relief only to the individual party seeking relief and only to the extent necessary to resolve that individual’s Claim.

9.4 Informal Dispute Resolution

Before initiating arbitration, you agree to first contact Consumer Credit Counseling LLC and provide an opportunity to resolve the dispute informally.

Your written notice should include:

  • A description of the dispute.
  • Relevant dates and facts.
  • The relief you are requesting.
  • Any supporting information reasonably necessary to evaluate the dispute.

Nothing in this section limits any right or remedy that cannot lawfully be limited or waived.

9.6 Governing Law

Except where federal law controls or where otherwise required by applicable law, these Terms will be interpreted under the laws applicable to the relationship between you and Consumer Credit Counseling LLC, without regard to conflict-of-law principles.

9.7 Severability

If any provision of this Arbitration Agreement is found invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by applicable law.

10. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES

The Service may rely on internet services, software, platforms, and third-party technologies that are outside our direct control.

While we make reasonable efforts to provide accurate and current information, we do not guarantee that all descriptions, information, content, or other materials available through the Service are complete, accurate, current, or error-free.

We may correct errors, update information, or modify or discontinue portions of the Service at any time.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS.

Consumer Credit Counseling LLC disclaims warranties, express or implied, to the fullest extent permitted by applicable law, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, and uninterrupted or error-free operation.

Nothing in this section excludes or limits liability that cannot legally be excluded or limited.

11. LIMITATIONS OF OUR LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONSUMER CREDIT COUNSELING LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, AND OTHER RELATED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR CONTENT.

This may include, without limitation, loss of profits, loss of data, business interruption, or other indirect losses.

These limitations apply regardless of the legal theory asserted and even if we were advised that such damages might occur, except to the extent prohibited by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF $25 OR THE AMOUNT YOU PAID TO CONSUMER CREDIT COUNSELING LLC FOR THE SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain limitations of liability. Where such limitations are not permitted, they will apply only to the maximum extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited or waived.

12. UPDATES TO THESE TERMS

We may update or modify these Terms from time to time.

When we make changes, we may update the “Last Updated” date at the beginning of these Terms.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

If you do not agree to revised Terms, you should discontinue use of the Service.

13. GENERAL PROVISIONS

13.1 Company Consent or Approval

Where these Terms require our consent or approval, such consent must be provided by an authorized representative of Consumer Credit Counseling LLC.

13.2 Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Consumer Credit Counseling LLC and its related parties from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your User-Generated Content.
  • Your infringement of another person’s rights.
  • Your fraudulent or misleading conduct.
  • Your misuse of the Service.

This provision does not limit any rights or causes of action that cannot legally be waived.

13.3 Operation of Service

The Service is operated from the United States.

We do not represent that the Service is appropriate or available in every jurisdiction.

If you access the Service from outside the United States, you are responsible for complying with applicable local laws.

13.4 Export Controls

You agree to comply with applicable U.S. and international export-control laws and regulations.

You may not use, export, or re-export software or other Service materials in violation of applicable sanctions or export restrictions.

13.5 Severability and Interpretation

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in effect to the maximum extent permitted by law.

13.6 Investigations, Cooperation With Law Enforcement, and Termination

To the extent permitted by law, Consumer Credit Counseling LLC may investigate suspected violations of these Terms, security incidents, fraudulent activity, or unlawful conduct.

We may cooperate with law enforcement and government authorities where legally required or reasonably necessary.

We may suspend or terminate access to the Service, including user accounts, when appropriate and subject to applicable law.

Termination does not eliminate obligations that by their nature should survive termination, including provisions relating to intellectual property, indemnification, disclaimers, limitations of liability, dispute resolution, and applicable governing law.

13.7 Assignment

Consumer Credit Counseling LLC may assign its rights or obligations under these Terms as part of a merger, acquisition, corporate restructuring, sale of assets, or other business transaction.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where otherwise permitted by applicable law.

13.8 Complete Agreement; No Waiver

These Terms, together with any applicable Additional Terms and our Privacy Policy, constitute the agreement governing your use of the Service.

They supersede prior communications or agreements concerning your use of the Service to the extent permitted by law.

Failure to enforce any provision does not constitute a waiver of that provision or any other right.

Any waiver or modification must be made in writing by an authorized representative of Consumer Credit Counseling LLC unless otherwise permitted by applicable law.
